These Terms of Service (the "Terms") govern the use of the AI-powered brand management and social media automation platform (the "Service") provided by İndoles Yazılım Anonim Şirketi ("Aduardo", "we") at aduardomind.com. Company address: Kara Hasan Sokak No: 7A, Beşiktaş, Istanbul, Türkiye; MERSIS number: 0478104423800001. By using the Service you are deemed to have accepted these Terms. On first sign-in you are asked to confirm the Terms and the Privacy Policy; your confirmation is kept with its date.
Aduardo is a SaaS platform that helps brands manage their digital assets. The platform provides:
3.1 Plans. The Service is offered under the Basic, Regular, Pro and Agency plans. Each plan has a monthly token allocation, a number of brands and a user capacity. Current details are on the Pricing page.
3.2 Token system. AI-powered features (content generation, image creation, brand analysis, etc.) are used in exchange for tokens. The token cost of the main types of operation is published on the Pricing page. The allocation renews every month; unused tokens carry over to the next month while you have paid access (an active subscription). The accumulated positive carry-over can be at most one month's package allocation. If the period without paid access lasts longer than one calendar month, the positive carried balance lapses; if it is one month or shorter, it is kept. The free trial also counts as paid access; unused tokens carry over to the next month during the trial too, under the same rules. For demo accounts opened by our team, however, one total token allowance is set for the whole trial; it does not renew each month and the monthly carry-over rule does not apply, the unused part of the allowance stays usable during the trial, and once it is used up you need to contact our team for more tokens. On demo accounts some operations and the amount of use are limited; generation may stop even if a token balance remains.
3.4 Free trial. New users who sign up themselves may benefit from a 14-day free trial; for accounts opened by our team the trial length and token allowance are set separately. When payments are enabled: if you have a saved card during the trial, the first payment for your subscription's plan and period is charged to that card automatically 3 days before the trial ends. This also applies if you saved the card during the trial rather than when starting it. If you have no saved card, no automatic payment is taken; you need to select a plan to continue.
3.5 Refunds. When payments are enabled, the refund terms will be published in this section.
6.1 Your content and derived data. Content you upload to the platform or create with AI belongs to you. Aduardo processes this content to provide the Service.
You also grant Aduardo a limited, non-transferable right to use anonymised data derived from your content and your brand's data to operate and improve the Service and, in future, to develop its own models. The model-development use starts once the pipeline built for it is switched on and 30 days after the notice to existing users. This right cannot be licensed or transferred to third parties.
We do not sell or rent your personal data; we do not sell, license or transfer training datasets or models to third parties; your data is shared only with providers that help us deliver the Service, and only to the extent necessary.
The brand owner (OWNER) can take the brand out of this use with the "Ortak öğrenme ve model geliştirme" switch under Ayarlar → Proje & Veri → Veri ve öğrenme (Settings → Project & Data → Data and learning). When the switch is turned off, the brand is removed from its contributions to the shared pool, no new data enters these two uses, and the brand also stops using the sector insights in the shared pool. 6.2 Aduardo's rights. The platform software, design, logos, algorithms and technological infrastructure belong to İndoles Yazılım Anonim Şirketi; they may not be copied, reproduced or reverse engineered without permission.
You agree to comply with the following rules while using the Service:
In the event of conduct contrary to these rules, your account may be suspended or permanently closed, with or without prior warning.
Aduardo cannot be held liable for direct, indirect, special, incidental or consequential damages (including loss of profit, loss of data or loss of reputation) arising from the use of the Service. Aduardo's total liability cannot exceed the subscription fees you paid in the last 12 months.
Aduardo reserves the right to change these Terms upon prior notice. Material changes are announced at your registered e-mail address and/or through an in-app notification. Continuing to use the Service after a change means that you accept the current Terms.
These Terms are subject to the laws of the Republic of Türkiye. The Istanbul (Çağlayan) Courts and Enforcement Offices have jurisdiction over disputes.
